JSC "Financial Center", acting as the operator of the authorized body in the field of education and ensuring monitoring and control over the fulfillment by young specialists and Doctors of Philosophy (PhD), who studied under the state educational grant, of their obligations to complete the mandatory employment period or to reimburse budgetary funds in case of non-fulfillment, hereby informs as follows.

In response to an incoming SMS message from the "1414" contact center offering to provide consent to JSC "Financial Center" (message "511") or to refuse consent (message "512"), students of higher and postgraduate educational institutions, as well as graduates of bachelor's, internship, residency, master's, and doctoral programs, are given 15 minutes to respond. After the expiration of this time period, the message shall be considered invalid.

Upon sending the message "511" (consent) to the "1414" contact center for the collection and processing of personal data, limited information will be provided to JSC "Financial Center" by the Ministry of Labor and Social Protection of the Republic of Kazakhstan. This information includes the employer's BIN or IIN, the name of the organization, the employer's address, and the periods during which mandatory pension contributions were made.

At the same time, no other confidential personal data contained in the records of the Ministry of Labor and Social Protection of the Republic of Kazakhstan will be disclosed to JSC "Financial Center".

If the message "512" (refusal) is sent to the "1414" contact center regarding consent to the collection and processing of personal data, students of higher and postgraduate educational institutions, as well as graduates of bachelor's, internship, residency, master's, and doctoral programs, will be required to independently submit to JSC "Financial Center" supporting documents confirming the fulfillment of their mandatory employment obligation before the expiration of the three-year or two-year mandatory employment period.

What regulatory legal acts provide for the obligation of young specialists to work off?

In accordance with paragraph 17 of Article 47 of the Law "On Education" of the Republic of Kazakhstan, mandatory three-year service after completion of higher and (or) postgraduate education is imposed on citizens who studied on the basis of the state educational order in:

  • within the quota for pedagogical, medical and veterinary specialties, they are obliged to work in state educational organizations, state medical organizations, state veterinary organizations located in rural areas;
  • educational grant for pedagogical and medical specialties in state educational organizations and state healthcare organizations;
  • educational grant for all other specialties work in organizations, regardless of ownership (since 2017 admission, young specialists);
  • PhD doctors work in higher and (or) postgraduate education organizations or scientific organizations.
How is the distribution of graduates to work carried out and who is in charge of it?

Commissions for personal distribution are created annually for pedagogical and veterinary specialties at the relevant universities of the Republic of Kazakhstan, where young specialists and PhD doctors complete their studies, and for medical specialties, the Commission is created in the authorized body in the field of healthcare.

The Commissions carry out personal distribution of young specialists and PhD doctors based on the employer's petition.

This procedure is defined by the Rules for directing a specialist to work, approved by the Resolution of the Government of the Republic of Kazakhstan dated March 30, 2012 No. 390.

Does a graduate under the rural quota have the right to work in the city?

No, if a young specialist has completed training under the rural quota in pedagogical and medical specialties according to paragraph 17 of Article 47 of the Law "On Education", the young specialist is obliged to work in state educational/healthcare organizations located in rural areas.

What to do if there is no vacancy at the graduate's place of residence?

According to paragraph 17-1 of the Resolution of the Government of the Republic of Kazakhstan dated March 30, 2012 No. 390, in the absence of vacancies, a young specialist/PhD doctor must register as a job seeker directly at the employment center at the place of residence or through the "electronic government" web portal or the State Corporation "Government for Citizens", with the time of being registered as unemployed being counted towards the work-off period.

When should a graduate arrive at the place of work?

Young specialists and PhD doctors who have completed their studies in the current year arrive at their place of work according to the referral (in accordance with the decision of the Commission for Personal Distribution of Young Specialists and PhD Doctors) no later than September 1.

What measures are taken in case of non-fulfillment of work obligations?

JSC "Financial Center" as an operator of the authorized body in the field of education ensures monitoring and control over graduates' compliance with their obligations to work off or reimburse budget funds in case of non-fulfillment.

In case of identified violations regarding work-off, JSC "Financial Center" works with the young specialist: preparation of a written notification about mandatory work-off, calling young specialists. If violations are not eliminated, work is carried out to return budget funds to the state, including through the court.

Is a deferral provided to the graduate, and for what period?

Upon admission or conscription for military service, a young specialist is granted a deferral (by decision of the Commission for Personal Distribution of Young Specialists and PhD Doctors, an additional protocol is drawn up based on a written application and supporting document) for the duration of service, without counting the time of service towards the work-off period.

In what cases are graduates exempt from working off?

Exemption from the obligation to work off is granted by decision of the Personal Distribution Commission to the following categories:

  1. persons in case of absence of vacancies in the locality of residence, work or service of the spouse;
  2. disabled persons of groups I and II;
  3. persons who entered for further studies in master's, residency, doctoral programs;
  4. pregnant women, persons who have or independently raise a child (children) under the age of three.
Will work in the akimat, tax committee, PSC be counted?

No, it is not possible to count work in the above organizations. According to paragraph 17 of Article 47 of the Law of the Republic of Kazakhstan "On Education", citizens who entered training in pedagogical, medical specialties work respectively in state educational organizations, state healthcare organizations. A young specialist must be employed in a state educational organization (school, kindergarten, nursery-kindergarten, college, university) and a state healthcare organization (hospitals, polyclinics).

Does the obligation to work off cease due to marriage?

For proper fulfillment of the work-off obligation, a young specialist is obliged to work in a state educational organization for at least three years, or register as unemployed at the employment center at the place of residence. In case of non-fulfillment of the work-off obligation, the young specialist is obliged to reimburse the expenses incurred from budget funds in connection with their education to the republican budget.

Is exemption from work granted upon admission to master's program?

In this case, the young specialist must contact the Personal Distribution Commission, which is created at the relevant organizations of higher and (or) postgraduate education where the young specialist studied, to obtain exemption from work-off. According to paragraph 17-2 of Article 47 of the Law of the Republic of Kazakhstan "On Education", provisions are provided that exempt from mandatory work-off upon admission for further studies in master's, residency, doctoral programs.

Is it possible to count work in organizations with state participation?

For proper fulfillment of work-off obligations in pedagogical and medical specialties, a young specialist is obliged to work in a state educational organization and a state healthcare organization. The Law "On State Property" states that a state legal entity is state institutions and state enterprises. It is not possible to count work-off in quasi-state sector organizations.

Are persons who entered master's program in subsequent years exempt?

From the meaning of the Law, it follows that Commissions have the right to exempt young specialists from work-off only in the case of admission to master's, residency, doctoral programs in the year of graduation, but not in subsequent years, that is, when considering the issue of exemption from work-off, the time factor must be taken into account, namely the timeliness of fulfillment of obligations.

Is it possible to pay the debt in installments or for the remaining period?

According to the Law and Rules, there are no provisions for recalculation of budget funds spent in case of partial work-off or installment reimbursement of budget funds related to education. At the same time, the tuition fee is formed annually by the Resolution of the Government of the Republic of Kazakhstan with the average costs of training 1 student per academic year.
